CHARM-COPD PRIVACY POLICY

The CHARM-COPD App supports remote clinical monitoring for individuals with COPD. Users can input daily symptoms, vital signs such as blood pressure, heart rate, and oxygen saturation. It also syncs with your Fitbit to track key health metrics. CHARM-COPD helps people track their health trends over time.

All information in App CHARM-COPD (the “App”) is protected by copyright in Canada and internationally. The App, including all images, photographs, animations, text and other audiovisual materials, and any and all patents, copyrights, moral rights, trademarks, trade secrets and any other form of intellectual property rights recognized in any jurisdiction, including applications and registrations for any of the foregoing embodied therein are owned by University Health Network (“UHN”), Sunnybrook Research Institute (“SRI”) and the Governing Council of the University of Toronto (“UofT”), or their respective licensors.  No information can be reproduced or distributed without the prior and express permission of UHN, SRI and U of T.

COLLECTION OF DATA AND PRIVACY

1. Transmission of non-identifying data to UHN and SRI.
We collect non-personally identifiable data (which is transmitted back to us) through the App regarding the use of the App in order to better understand use of the App and to help us identify areas for improvement. If you do not consent to the transmission of this data to UHN or SRI, then you must not use the App. Additionally details about the data we collect can be found in the End-User License Agreement (“EULA”).

2. Transmission of Identifying Data and PHI and SRI.
The App also allows users to enter certain personal information and/or personal health information (“PHI”). Any information sent is not collected by UHN, SRI or U of T and no copy is sent to us by the App.

3. Other Information Collected by the App

a. User Provided Information
The App collects the information you provide when you download and register the App.
When you register with us and use the App, you generally provide (a) your name (first name or pseudonym), email address, age, gender, username, password and other registration information; (b) information you enter into the App regarding your condition, which may include self-reported symptom information, audio recordings, and goals; (c) information you share in the electronic messages to clinicians; and (d) information you provide us when you contact us for technical help with the App. The research team may also use your contact information (phone or email) to share important information about the App and required updates.

b. Automatically Collected Information
In addition, the App may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile operating system, and information about the way you use the App. This information is collected for analytics.

4. Third Party Access
Only aggregated, de-identified data is transmitted to external services to help us improve the App and our service. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • with our trusted services providers who work on our behalf, do not have any independent use of the information we share with them, and have agreed to adhere to the rules set forth in the EULA, any written agreements and the Personal Health Information Protection Act, 2004 and any subsequent amendments.

5. Use of your Information by your Health Care Team
The information you enter into this App may not be provided to your healthcare team and may not become part of your medical record.

6. What are my rights?
You can stop all collection of information by the App easily by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

7. Data Retention and Managing Your Information
We will retain User Provided data for as long as you use the App as per standards of the research trial. For the purposes of the research trial, your data will be stored for 10 years as per the Records Retention Policy.

8. Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain.
For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our App.
